TEGOS represented Operail in several high-profile disputes against Estonian Railways concerning the legality and calculation of rail infrastructure charges. The disputes, some of which dated back more than a decade, involved issues for which there was little or no existing court practice in Estonia.
The matters concerned both the calculation of infrastructure fees and charges imposed for access to shunting yards and train formation facilities. The disputes required extensive analysis of EU railway legislation and comparative assessment of regulatory approaches adopted across Europe.
The cases were of significant importance to the Estonian rail sector and contributed to clarifying the legal framework governing rail infrastructure charging and the relationship between railway operators and infrastructure managers.
