Forward Tranzit OÜ has prevailed in a complex international dispute before the Harju District Court concerning increases in railway freight tariffs.
The case arose after a Latvian company contested tariff adjustments linked to Operail’s cost increases following sanctions connected to the Russian-Ukrainian war. Initially, the company had accepted the new tariff and paid the invoices. Still, later it challenged the validity of the price changes.
The Harju District Court dismissed all claims, finding that the increase of the tariff was in accordance with the agreement between parties. The judgment is a significant precedent for the freight forwarding sector, addressing how war-related cost increases are allocated between forwarders and customers. The court has confirmed that the established practise in the transport sector that the forwarder may increase the tariff unilaterally was correct from the legal point of view.
