A precedent-setting dispute worth €24 million over a public procurement for ferry lines

The Supreme Court decided not to accept the appeal in cassation filed by the bankruptcy trustees of Saaremaa Laevakompanii (SLK) and Väinamere Liinid. As a result, the judgment of Harju County Court of 31 March 2023 entered into force, dismissing the claim brought by SLK and Väinamere Liinid against the subsidiaries of Tallinna Sadam.

SLK and Väinamere Liinid sought compensation from Tallinna Sadam’s subsidiaries TS Laevad OÜ and OÜ TS Shipping for alleged damages totalling €23.8 million, claimed to have arisen from the use of trade secrets in the course of participating in a public procurement for passenger ferry services on the Saaremaa and Hiiumaa routes.

By its judgment of 31 March 2023, Harju County Court dismissed the claim. On 9 February 2024, Tallinn Circuit Court dismissed the appeal filed by SLK and Väinamere Liinid and upheld the judgment of Harju County Court.
