The Lithuanian Court of Appeal has upheld the first-instance decision, confirming that TEGOS client, AUGA Group, AB (the respondent) was justified in terminating the contract with UAB ITVISION (the claimant).
UAB ITVISION was responsible for implementing an international, modular business management system designed to automate and manage various company processes. This was a complex, customized “Odoo” implementation project, involving programming, consulting, and integration with other systems.
The courts, granting the counterclaim of AUGA group, AB, decided that, since the claimant did not deliver the complete software to the respondent, did not perform full testing, did not remedy the defects identified during testing, did not install the software, and did not ensure that the developed system met all of the respondent’s requirements, there are no grounds to conclude that the obligation of the claimant was properly fulfilled.
The outcome for AUGA group, AB is a decision applying restitution and awarding a significant amount of incurred losses, along with annual interest and litigation costs.
