TEGOS assisted the client in the transfer of employees to its Polish entity, ensuring full compliance with the requirements of the Lithuanian labour code and TUPE directive.
TEGOS role included advising on all legal aspects of the employee transfer process, including legal support on signing employee’s transfer agreement and guiding the client through the entire transition process. Beyond the transfer, TEGOS provided comprehensive legal support on a wide range of employment law issues relevant to the transferred employees employment into the Polish entity. This included advising on working time regimes, overtime regulations, employee working conditions, health and safety compliance, remote work arrangements, and working time tracking obligations. TEGOS also assisted in drafting and implementing retention bonus agreements to help the client retain key personnel during the transition. Furthermore, the team advised on specific employment aspects such as on-call duty at home arrangements for employees.
This matter was important as it involved navigating complex employment law frameworks during a cross-border expansion, requiring coordinated advice across multiple legal areas. TEGOS’s involvement was crucial in enabling the client to establish a compliant and efficient employment structure.
