TEGOS (formerly TGS Baltic) successfully represented the company Ebeta AS both in the county court and in Tallinn Circuit Court against a web developer.
The defendant repeatedly delayed the performance of contractual obligations and, thus, the plaintiff withdrew from the contract, demanded repayment of the advance payment and compensation for damages. Both court instances agreed with the plaintiff and order the defendant to pay these sums together with default interests.
The main issue of the dispute was whether the plaintiff withdrew from the contract validly – was there a material breach of the contract in a situation where the grant of an additional period for performance of the obligation was due to circumstances, even though it was not expressly provided?
