Successfully represented Sargasas in a complex employment dispute

TGS Baltic successfully represented a client in a complex employment dispute concerning the dismissal of an employee for gross misconduct related to the intentional setting of fire to the client’s premises.

The client terminated the employee’s contract after suspecting that the employee had intentionally set fire to the company’s premises, causing damages amounting to EUR 500,000. However, no direct evidence of the employee’s involvement in the incident was available, and the pre-trial investigation in the related criminal case was closed without charges for the employee during the examination of the case at the court of first instance. Despite these challenges, TGS Baltic successfully defended the client’s interests in both the first instance and appeal courts. The courts ruled that the employee’s dismissal was lawful, based on employee‘s loss of trust, and awarded the client full compensation for all litigation expenses incurred.

The case was particularly complex and complicated due to the absence of direct evidence that the employee set the fire. Nevertheless, TGS Baltic was able to gather and present strong circumstantial evidence, convincing both courts that the employee’s dismissal was legal and justified.
