Successfully defended Transrevis in a first-instance court in an employment dispute

TGS Baltic successfully defended a client in a first-instance court in an employment dispute concerning the dismissal of an employee from a non-EU country who lost her driving privileges after residing in Lithuania for 185 days. As a result, the client terminated her employment contract on a specific and rare ground provided in the Lithuanian Labour Code – termination of the employment contract without the mutual consent of the parties, in cases where an employee, under the procedure established by law, loses the special rights required to perform certain work. The employee challenged her dismissal, alleging discrimination compared to other employees and claiming that the employer failed to assist her in maintaining her right to drive in Lithuania.

TGS Baltic represented the client and proved that the employee’s dismissal was lawful, demonstrating that the employer had made every effort to help the employee retain her driving rights, while the employee showed lack of initiative. The firm also successfully disproved the allegations of discrimination. The court ruled in favor of the employer, confirming the legality of the dismissal. The employee did not appeal the decision, which therefore became final.

This matter was significant as it involved a rare and complex issue of employment law concerning the termination of employment due to the loss of legal rights. With limited court practice in similar cases, TGS Baltic’s expertise was essential in achieving a successful outcome for the client.
