We represented LTG Infra, a subsidiary of the largest railways group Lietuvos Geležinkeliai (Lithuanian Railways) in the Baltic States, in a construction dispute regarding compensation of damages allegedly incurred by one the client’s contractors.
The court rejected the statement of claim in full and concluded that the contractor fully assumed the risk in connection with performance of the contractor’s contract. The court also acknowledged the claimant did not comply with the mandatory pre-litigation provision. Our arguments convinced the claimant and it did not appeal.
