We represent UAB “Biotechpharma”, a leading Lithuanian biopharmaceutical manufacturer, in a high-value cross-border commercial dispute against Swedish companies ISR Immune System Regulation AB and ISR Vaccine AB. The case concerns the production of spike protein components for a SARS-CoV-2 vaccine.
The dispute arises from a series of contracts concluded between 2021 and 2022 for the development and GMP-compliant manufacturing of vaccine components. Despite Biotechpharma’s full performance of its contractual obligations, the defendants failed to pay for delivered services and materials. The claim includes EUR 3.9 million in unpaid invoices, EUR 238,000 in contractual interest, and a EUR 6.3 million cancellation fee – bringing the total claim to EUR 10.5 million.
The matter is further complicated by the international nature of the dispute, the defendants’ poor financial standing, and the strategic importance of the underlying vaccine development project. The case also involves the enforcement of jurisdiction and governing law clauses under EU private international law, as well as the application of interim measures to secure the claim.
This is one of the largest biotech-related commercial disputes in Lithuania and showcases our team’s ability to handle complex, high-stakes litigation involving international parties, pharmaceutical manufacturing, and strategic enforcement of contractual rights.
