TEGOS advised Orivas, a pharmaceutical distribution company operating in the Baltics, on a comprehensive trademark registration and brand protection program designed to support the client’s strategic ambition to expand its pharmaceutical product portfolio across the entire European Union market.
The client came to TEGOS at a pivotal moment in its commercial development. Having established a strong position in its home market, the client was actively pursuing pan-European growth and needed a trademark protection framework that would not only secure its existing brand assets but provide the territorial coverage and legal robustness necessary to compete and enforce rights across all EU member states. TEGOS designed and executed a strategy to deliver precisely that.
The engagement encompassed two distinct but interconnected workstreams. In the first, TEGOS conducted a comprehensive IP landscape review for one of the client’s key pharmaceutical products, covering trademark registrations, packaging design protection, and patent and supplementary protection certificate status across multiple jurisdictions. The review provided the client with a precise, product-specific picture of the existing EU-wide IP landscape, identifying which elements of the product’s brand and packaging already enjoyed registered protection and, critically, which remained exposed — equipping the client with the intelligence needed to prioritize its investment in new IP protection as it moved into new markets.
In the second and more substantial workstream, TEGOS advised and represented the client in a multi-mark trademark registration program covering one of its key pharmaceutical product brands, with EU-wide protection as the overarching objective. A pivotal strategic recommendation made by TEGOS at the outset shaped the entire approach: rather than seeking protection for the product’s packaging under design registration, which would have offered narrower and more time-limited protection ill-suited to the client’s long-term pan-European ambitions, TEGOS recommended registering the packaging elements as figurative trademarks at the EU level. This approach delivers significantly broader territorial coverage, longer-lasting protection, and stronger enforcement rights across all member states simultaneously, and was adopted in full by the client.
Pursuant to this strategy, TEGOS coordinated the registration of both a word trademark and multiple figurative trademarks covering the product’s distinct color variations, managing the process from initial strategic scoping through to file preparation and submission. This required close coordination with the client’s marketing team to ensure that the graphic files submitted met the technical requirements for figurative mark registration across jurisdictions, with TEGOS proactively guiding the client through the preparation of correctly formatted, centered, and color-accurate artwork for each mark variant.
